Penalties and disqualifications for serious traffic offences

The Government is determined to reduce the trauma and financial cost to the community arising from death and injuries on NSW roads.

There are tough penalties in force for speeding, drink-driving, unlicensed driving and other serious driving offences in NSW (see links above right). Immediate roadside licence suspension may also apply for certain speeding, drink-driving and other serious offences causing death or grievous bodily harm.

Special attention has been given to second or subsequent offences to make the penalties much heavier.

A reference to a second or subsequent offence generally refers to:

  • The second or subsequent occasion on which the offence was committed in the past five years.
  • The first occasion on which it was committed if the person had committed any major offence (referred to in section 188 of the Road Transport (General) Act 2005) within the past five years.
