The SDRO will send you a penalty notice that will detail the incurred traffic offence penalty.
Owner Onus
What if someone else was driving my car when it was photographed?
The owner onus legislation was established by the Government to enable enforcement of offences such as illegal parking, red light running and speeding (detected by cameras). The legislation was passed by the Parliament of NSW.
Under the Road Transport (General) Act 1999 (section 43) the registered owner of a vehicle which has been detected by a fixed speed camera is considered to be guilty of the designated offence unless the owner supplies by statutory declaration, the name and address of the person who was in charge of the vehicle at the time of the offence.
Failure to nominate a driver of the offending vehicle within 21 days from the service of the notice or the false nomination of a person in charge of the vehicle can attract further severe penalties (generally up to 10 times the original penalty) plus the payment of the original penalty.
