Court ruling against Victoria heavy vehicle director

The director of a large Victoria-based heavy vehicle company has been prosecuted for 89 mass and dimension offences committed by his company.

On 2 October 2008 at Goulburn Local Court, Bullin Pty Ltd (ACN: 21 105 596 389) Director John Bogdan was held liable for the offences in his capacity as Director, under the Road Transport (General) Act 2005.

An RTA spokesperson understood it was the first time a director had been successfully prosecuted for offences committed by a transport company. The court imposed $158,697 in fines, court costs and professional fees.

“Bullin Pty Ltd went into liquidation in October 2007 after recording over 500 mass and dimension offences between December 2003 and October 2007,” the spokesperson said.

“The company owed in excess of $72,000 in unpaid court fines and $185,000 in unpaid infringement notices.

“Throughout this period Bullin Pty Ltd was operating about 46 Victoria-registered prime movers.”

Chain of responsibility laws in NSW relate to mass, dimension and load restraint matters and last month were extended to cover fatigue and speeding in the heavy vehicle industry.
