The Environmental Planning and Assessment Act 1979, is the primary legislation governing land use and development in NSW. The Act establishes a model that regulates land use planning and environmental assessment and which contains important provisions relating to community involvement, environmental protection and dispute resolution.
Recognising its responsibilities under the Act, Roads and Maritime Services (replacing Roads and Traffic Authority) has developed and established its own environmental planning processes. They ensure that all statutory town planning and environmental impact assessment requirements are an integral part of Roads and Maritime Services (replacing Roads and Traffic Authority)’s project planning, implementation, operation and maintenance.
